Most such arbitrators are retired judges and/or practicing attorneys. Instead, a Texas injured Wal-Mart employee would be forced to have his or her dispute heard by usually a single arbitrator. There is also no judge or courtroom involved. An injured worker would not be able to have a jury of his or her peers decide a work injury dispute. Arbitration is similar to a lawsuit, but it occurs in a private setting. One additional thing that Wal-Mart does regarding its employees, which is very common among employers of injured workers in Texas, is that it requires that its employees agree to arbitration of any work injury disputes. Every case is different, and an injured Texas Wal-Mart employee might or might not be entitled to any or all of such damages. A person injured in a Texas work accident is entitled to compensation for any past medical expenses, future medical expenses, past pain and suffering, future pain and suffering, past mental anguish, future mental anguish, past disfigurement, future disfigurement, past loss of earning capacity, future loss of earning capacity, past physical impairment, and/or future physical impairment. Even so, an employee still had rights to file a claim against Wal-Mart for other compensation available under Texas law. However, it is also our understanding that Wal-Mart, and/or a separate insurance company, might provide compensation for medical care and/or some lost wages in the event a Texas Wal-Mart employee is injured in a work accident. It has distribution centers in cities and towns including Plainview, Baytown, Sanger, Sealy, Palestine, Cleburne, DeSoto, Terrell, Fort Worth, New Braunfels, Temple, Dayton, and New Caney. Wal-Mart has numerous locations throughout the State of Texas. Therefore, if there is an accident at Wal-Mart, and the person injured is an employee acting in the normal course of his or her duties for Wal-Mart, then there is no workers compensation coverage available. A nonsubscriber employer is one that does not obtain and/or secure workers compensation coverage for its employees. It is our understanding that Wal-Mart, in Texas, is a nonsubscriber employer.
